What happened
On October 28, 2025, the Texas Comptroller froze new HUB certifications and renewals (per Jackson Lewis). On December 2, 2025, an emergency rule turned the HUB Program into "VetHUB," open only to firms owned by service-disabled veterans with a 20% or higher disability rating. On January 6, 2026, the Comptroller cancelled HUB certificates held by minority- and women-owned firms (per Jackson Lewis). Four firms and a contractor trade group sued on March 2, 2026. In April 2026, a Travis County judge issued a temporary injunction that reinstated the six firms in the suit (per The Texas Tribune via WTOP, and SAHCC).
The Comptroller then adopted final rules that took effect May 12, 2026, and withdrew the emergency rule. On August 20, 2026, the Fifteenth Court of Appeals vacated the temporary injunction (case 15-26-00091-CV, opinion filed September 20, 2026). It kept the lawsuit alive and sent it back to the trial court, because the adopted rules carried the same policy forward.
What it means for your bids
- The temporary injunction no longer protects anyone, including the six firms that sued. Cancelled HUB certificates do not count on state bids.
- The Comptroller's certification page describes only VetHUB. The VetHUB Directory replaces the HUB Directory for state buyers.
- Subcontracting plans have not gone away. The Comptroller's "VETHUB Forms" page still posts the Subcontracting Plan Form, Good Faith Effort forms and Progress Assessment Reports.
- Bids on state contracts of $100,000 or more still require a subcontracting plan with good faith efforts (per Jackson Lewis, October 2025; the threshold was not shown on a Comptroller page we could reach).
- You can still compete for state contracts. Registering on the Centralized Master Bidders List (CMBL) is separate from HUB or VetHUB status.
What to do now
- Check your current status in the VetHUB Directory: https://mycpa.cpa.state.tx.us/tpasscmblsearch/index.jsp
- Read each new bid's subcontracting section. Use the current forms from the Comptroller: https://comptroller.texas.gov/purchasing/vendor/hub/forms.php
- If you are a prime bidder, keep records of your good faith outreach to subcontractors. Agencies check these.
- Read the VetHUB rules on the Comptroller's page to see who the program covers: https://comptroller.texas.gov/purchasing/vendor/hub/certification-process.php. Applications go through the VetHUB Certification Portal (https://vethub.gob2g.com/). Certification is free.
- Keep your old HUB certificate and any decertification notice in case the lawsuit changes the outcome.
- Keep your CMBL registration current so you still get bid notices.
Watch out for
- Trial: reported for November 9, 2026, in Travis County (per WTOP and The University Star; not confirmed on a court or Comptroller page). The outcome could restore, change or end the old program.
- The appeals court did not rule on whether the VetHUB rules are lawful. That is still for the trial court.
- News reports disagree on dates. Some list December 2, 2025 as the day certificates were stripped and March 2, 2026 as the injunction date. Our dates follow Jackson Lewis and WTOP.
- Not every page on the Comptroller's site has been updated. If a page still says "HUB," check the date and ask the office.

- City, county and school district programs in Texas are separate from the state program. Check each one.
