DBE Re-evaluation and Certification: What Changed and What to Submit

What changed
USDOT removed the "race- and sex-based presumptions of social and economic disadvantage." Before, owners in certain groups were presumed disadvantaged. Now every owner must prove disadvantage from their own experiences. Every firm already certified as a DBE (Disadvantaged Business Enterprise) or ACDBE (Airport Concession DBE) is being re-evaluated by its state's Unified Certification Program (UCP), the body that certifies firms in each state.
Key dates:
- Oct 3, 2025: Interim final rule takes effect. Presumption removed. Re-evaluations begin.
- Sep 25, 2026: Final rule takes effect.
- Dec 24, 2026: UCPs must finish re-evaluations. DOT may grant a UCP "a one-time extension of up to 90 days" (49 CFR 26.111).
- Mar 24, 2027: Last day for a firm that hasn't responded to send its narrative and net worth statement. If the UCP got an extension, the firm instead has "90 days of the UCP's extended deadline." Miss it, and the firm is "automatically disqualified."
Note: the regulation text sets Mar 24, 2027 (or 90 days after an extended UCP deadline) as the final firm deadline. DOT's FAQ (Q17, Q22) says the same. After that date, the UCP issues a notice disqualifying the firm.
Goals and counting. Since Oct 3, 2025, agencies "may not set any contract goals" and "may not count any DBE participation toward DBE goals until the UCP that covers you has completed the reevaluation process" (49 CFR 26.51(h), 26.55(i)). DOT's final-rule FAQ says counting may resume "starting from the date the UCP notifies the Department that the reevaluation process ... has been completed" (Q9). Before putting a DBE goal on a contract, the agency "must create and submit a new overall goal" (Q2). The same applies to ACDBEs under 49 CFR part 23.
Who has to do what
- Already-certified DBEs: When your UCP contacts you, send a personal narrative (PN) and a personal net worth (PNW) statement. Firms that haven't submitted "remain ineligible for counting towards DBE participation until they submit the required documentation" (IFR FAQ C.13). Keep filing your yearly Declaration of Eligibility, due "every year on the anniversary of its original certification" (49 CFR 26.83).
- New applicants: Apply to the UCP in your home state using DOT's Uniform Certification Application. "The U.S Department of Transportation does not review DBE applications." UCPs "are not permitted to refuse Uniform Certification Applications ... or pause applications that were already in process" during re-evaluation (final rule preamble).
- ACDBEs: Same process and dates under 49 CFR 23.81. UCPs report ACDBE and DBE completion separately (final-rule FAQ Q20), so the two can finish at different times.
- If a firm doesn't respond: The UCP sends a notice of nonresponse. After the deadline, the firm is "automatically disqualified by the UCP without further administrative proceedings" (49 CFR 26.111(d)).

Personal narrative checklist (structure only)
What DOT says a narrative must cover:
- [ ] The owner's own experiences. The PN is "a statement of the owner's own experiences" (final rule preamble). It must give "individualized proof regarding specific instances" of hardship, barriers or denied opportunities (49 CFR 26.67).
- [ ] Specific incidents. "The PN should describe who, what, where, why, when, and how the disadvantage occurred" (final-rule FAQ Q9).
- [ ] An objective feature tied to the harm. Name at least one objective distinguishing feature (ODF). "A denial of an opportunity or unfavorable treatment alone, without additional information connecting the owner's ODF to the denial ... is not sufficient" (Q9).
- [ ] A pattern. "A pattern of specific instances of discrimination," showing the disadvantage "was chronic and substantial, not isolated or fleeting" (Q2).
- [ ] Economic harm. Explain "how and to what extent the impediments caused the owner economic harm" (49 CFR 26.67).
- [ ] Any time of life. Incidents may come "from any point in the owner's life" (Q2).
- [ ] Not group membership alone. "A generalized claim of membership in a historically disadvantaged group fails to meet the individualized evidentiary showing" (Q1).
- [ ] Standard of proof. Disadvantage must be shown "by a preponderance of the evidence" (49 CFR 26.67).
- [ ] Corroboration. Not required for every incident. The owner is not "required to provide independent corroborating evidence for every incident." But documents such as "correspondence, records of denied opportunities, or formal complaints ... may strengthen the showing." A "generalized or conclusory assertion ... is not enough" (Q3).
- [ ] No page limits. "Certifiers must not enforce page limits, mandate topics, or impose any other limitations" beyond the regulations (Q4).

Personal net worth (PNW) checklist
- [ ] Form: DOT's Personal Net Worth Statement (OMB 2105-0586, expires 05/31/2027). The rule points to transportation.gov/DBEFORMS for the current form. Check there or with your UCP for a newer version.
- [ ] Cap: $2,047,000, in effect since May 9, 2024. DOT will adjust it "by May 9, 2027" (DBEPNW; 49 CFR 26.68).
- [ ] Excluded from the total (49 CFR 26.68(c)):
- "her ownership interest in the applicant or DBE" (the form says "Do not report the value of the applicant firm")
- "her share of the equity in her primary residence"
- "all assets in qualified retirement accounts"
- Other listed items, such as certain payments for family members' health care, education or legal costs. Read 26.68(c) for the full list.
- [ ] Still fill in Worksheet 13 (retirement) and Worksheet 14 (primary residence), even though they are left out of the total.
- [ ] Under the cap isn't automatic. The UCP must do "a broad assessment of the owner's financial situation ... even if the owner does not exceed the PNW cap" (final-rule FAQ).
Documents usually needed:
- [ ] All PNW worksheets. The form says "Provide documents to support each entry."
- [ ] "Personal Federal tax returns for the past 3 years" for each disadvantaged owner (Uniform Certification Application checklist; your UCP may ask for these at re-evaluation too).
- [ ] A Declaration of Eligibility (DOE). Each owner "must submit a DOE and a corroborating personal net worth (PNW) statement, including required attachments" (49 CFR 26.68).

Where your state stands

Watch out for
- "Guaranteed certification" offers. No one can promise you'll be certified. The UCP decides. You can't buy certification.
- Free help exists. DOT's Small Business Transportation Resource Centers (SBTRCs) offer certification counseling, and "All services are provided free of charge." Your UCP can explain its own process. Application fees, if any, are set by the UCP. The federal rule allows a "reasonable" fee and requires waivers "in appropriate cases."
- The 90-day clock. For a new application, the UCP must decide "within 90 days of receiving all information required." The clock starts only when your file is complete. The UCP may extend once, by up to 30 days, with written notice.
- Missed deadlines. Not responding by Mar 24, 2027 (or 90 days after an extended UCP deadline) means automatic disqualification.

Common questions
When is the DBE re-evaluation deadline?
State UCPs must finish re-evaluations by December 24, 2026 (DOT can grant one 90-day extension). A firm that hasn't sent its personal narrative and personal net worth statement by March 24, 2027 is disqualified.
